{"id":35570,"date":"2014-03-12T10:14:57","date_gmt":"2014-03-12T09:14:57","guid":{"rendered":"http:\/\/wwwcinba.kinsta.cloud\/?p=35570"},"modified":"2023-10-27T09:09:51","modified_gmt":"2023-10-27T07:09:51","slug":"buying-votes-to-lijanovics-betterment","status":"publish","type":"post","link":"https:\/\/cin.ba\/en\/buying-votes-to-lijanovics-betterment\/","title":{"rendered":"Buying Votes to Lijanovi\u0107\u2019s Betterment"},"content":{"rendered":"<p>Stajka Aukst from Zavidovi\u0107i voted for Jerko Ivankovi\u0107 Lijanovi\u0107 and other candidates of the People\u2019s Party Through Work to Betterment (NSRZB) at the general elections four years ago. She did this on the promise that she would receive money for her vote. She didn\u2019t think at all about how those she voted into power would benefit.<\/p>\n<p>The election results helped Lijanovi\u0107 get the posts of Minister of Agriculture, Waterworks and Forestry and Deputy Prime Minister of the Federation of Bosnia and Herzegovina (FBiH). That made it possible for him to help pass laws that effect the lives of millions and to dispose of a budget that annually averages 70 million KM.<\/p>\n<p>The Federation Police Authority (FUP) alleges that Lijanovi\u0107 received votes by promising to pay for them and he fulfilled that promise with the money from the FBiH budget. Once in office, Lijanovi\u0107 amended the Program for Agricultural Incentives by introducing one-time subsidies without checks and balances. In this way, almost 3 million KM was dispensed to people who were supposed to vote or agitate for Lijanovi\u0107\u2019s party.<\/p>\n<p>The police filed a criminal report against him and 56 collaborators charging organized crime and abuse of office. Evidence consists of testimonies from at least 400 persons from FBiH and material evidence such as payment slips, inspections, and advice on how to vote. The complaint was sent to the Sarajevo Cantonal Prosecutor\u2019s Office.<\/p>\n<figure id=\"attachment_35558\" aria-describedby=\"caption-attachment-35558\" style=\"width: 950px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/grafika_brojke.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-35558\" src=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/grafika_brojke.jpg\" alt=\"\" width=\"950\" height=\"480\" \/><\/a><figcaption id=\"caption-attachment-35558\" class=\"wp-caption-text\">Illustration: CIN<\/figcaption><\/figure>\n<p>The activists lobbied poor people promising them 100 KM for a vote they would give to the party\u2019s nominees, and to some an additional 20 KM for every additional person that they swayed to vote for them. Aukst, a pensioner, accepted without thinking about the consequences. \u201cOn my mind at the time was how to make it better for everyone,\u201d she told the Center for Investigative Reporting in Sarajevo (CIN). She said that she voted for the party\u2019s candidates and Lijanovi\u0107 and won over another 45 voters.According to police, Lijanovi\u0107 organized party colleagues and activists and instructed them how to fish for votes ahead of 2010 elections. He promised them government jobs and 20 KM premiums for each voter that they talked into voting.<\/p>\n<p>The party ranked sixth at the elections in the FBiH and it received five seats in the FBIH Parliament. The party\u2019s vice-president Lijanovi\u0107 received 45,397 votes when running for membership in the BiH Presidency. He failed to secure that office, but he was invited into the Federation government and offered the minister and vice prime-minister posts.<\/p>\n<p>Prime Minister of the FBiH Nermin Nik\u0161i\u0107 told CIN that during consultations on the make-up the new FBiH government, Lijanovi\u0107 asked to become finance minister. \u201cBut, since we turned him down, he settled for the Ministry of Agriculture,\u201d said Nik\u0161i\u0107.<\/p>\n<p class=\"naslov\">Payment of Money<\/p>\n<p>At the time Lijanovi\u0107 became a minister, voters had not received their remuneration. The police investigation found that Lijanovi\u0107 amended the Program of Agricultural Subsidies so that he could pay the voters without anyone watching over his doing so. The FBiH government accepted the changes to the program with a note that this was the minister\u2019s decision. This paved the way for paying out one-time grants of 800 KM.<\/p>\n<p>In the meantime, party activists on the ground were instructing voters how to send in requests for one-time grants to the ministry or were filling them out on their behalf. Aukst said that she did not fill out the grant request herself, but she guessed that somebody from the party did that on her behalf. \u201cI just signed it,\u201d she said.<\/p>\n<p>A photo of an orchard was attached to the request. She said she did not own orchard and lived in a condominium.<\/p>\n<p>Nevertheless, she received an 800 KM agriculture grant. \u201cI got a list of people to whom I was to distribute money and what remained I took myself. I got the list in the party,\u201d said Aukst explaining what happened after the money arrived in her bank account. She kept 90 KM for her vote and 18 KM for each voter that she won over.<\/p>\n<p>\u201cThey had promised 20 KM and then it was 18 (KM). Voters were promised 100 (KM) and they cut it to 90. I have no idea why that happened,\u201d she said.<\/p>\n<figure id=\"attachment_35560\" aria-describedby=\"caption-attachment-35560\" style=\"width: 800px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/pecirepi.jpg\"><img decoding=\"async\" class=\"size-full wp-image-35560\" src=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/pecirepi.jpg\" alt=\"\" width=\"800\" height=\"533\" \/><\/a><figcaption id=\"caption-attachment-35560\" class=\"wp-caption-text\">Davor and Danijela Pecirep say that the ministry first wired 800 KM to their accounts and then approved a grant in that amount. (Photo: CIN)<\/figcaption><\/figure>\n<p>FBiH auditors warned in their 2011 audit of the Ministry that the Law on Subsidies in Agriculture and Rural Development was not envisioned as one-time grants.The grant requests that poured into the Ministry were examined by the Commission for Other Types of Supports. Lijanovi\u0107 appointed to the commission his advisers and party members: Suad \u010camd\u017ei\u0107, Ana Ba\u0161i\u0107 and Hanefija Topuz, who are also incriminated in the criminal report. According to the report, \u010cam\u017ei\u0107, Ba\u0161i\u0107 and Topuz reviewed the requests and gave a go-ahead even though many were incomplete. Some requests were not even signed.<\/p>\n<p>Lijanovi\u0107 signed off on 3,749 grant requests. The investigation found that the recipients did not keep all the money they received. Most kept the 100 KM they were promised for voting and gave the rest to activists who helped them get grants in the first place. Or, they shared the money with neighbors and family who also voted for the party. Police also found that some of the money was paid for election monitoring and late salaries in the Farmko firm the Lijanovi\u0107 company owns.<\/p>\n<p class=\"naslov\">Voting Instructions<\/p>\n<p>Kiseljak residents and spouses Danijela and Davor Pecirep who are unemployed and the parents of three children, were among those who received grants. They told CIN how their neighbor Nenad Raji\u0107\u2014the party\u2019s functionary for Kiseljak\u2014asked them if they wanted to earn 100 KM each.<\/p>\n<div class=\"infografika-min\">\n<figure id=\"attachment_35562\" aria-describedby=\"caption-attachment-35562\" style=\"width: 500px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/rjesenje_pecirep.jpg\"><img decoding=\"async\" class=\"size-full wp-image-35562\" src=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/rjesenje_pecirep.jpg\" alt=\"\" width=\"500\" height=\"693\" \/><\/a><figcaption id=\"caption-attachment-35562\" class=\"wp-caption-text\">The decision awarding Davor Pecirep a grant.<\/figcaption><\/figure>\n<\/div>\n<p>\u201cHe brought around documents, ballots. And it was according to numbers \u2013 which number we should vote, what do we need to encircle,\u201d Danijela recalls Raji\u0107 telling them before the elections. Still, the Pecireps did not want to say if they voted for the party.<\/p>\n<p>CIN has obtained the voters lists from Kiseljak from which it can be seen how one should vote. For example, Davor was instructed to vote at the state level for the party\u2019s nominees Vid Juki\u0107, Sanja Terzi\u0107, Ferid Ajanovi\u0107, Sunita Musli\u0107 and Toni Oroz; at the FBiH level for Junuz Brki\u0107, Zdenka Viskovi\u0107, Danijela Misilo and Tanja Kujund\u017ei\u0107; at the cantonal level for Karolina Pavlovi\u0107, Dane \u0160apin, Bla\u017eenka Luki\u0107, Andrea Terzi\u0107 and Mirela Gari\u0107. Numbers were pegged to each candidate.<\/p>\n<p>Danijela said that several days after the payment Raji\u0107 called again informing them that some people from the ministry were to come as part of an inspection. She said that she was surprised and she did not know what to expect. Commission members asked her \u201cif she sowed\u201d and she replied positively. Several days later, they received via post two grant decisions from the ministry.Danijela said that after the elections she ran into Raji\u0107 and asked him where the money was. Several days later Raji\u0107 called them to ask if they had opened bank accounts and if they would give him the bank accounts\u2019 numbers, \u201cso that some money can be wired for him and so that he could give them 100 KM each\u2026Not long after that, he called to say\u2014the money cleared (in the bank account), go and take it out,\u201d Davor said. He and his wife each withdraw 800 KM. They said that they gave Raji\u0107 1,400, and kept 200 KM.<\/p>\n<p>\u201cI have no clue what\u2019s going on; I did not ask for a grant,\u201d said Davor. He added that he did not even fill out the request. He believes that this was done by \u201ca person who copied his ID\u201d. \u201cI was in a critical situation. I had to prove that I did not take money, and how was I going to prove it? The party\u2019s management, they\u2019ve planned it and done it shrewdly. They could hide behind the paper they gave to me,\u201d said Pecirep. The couple told police in Kiseljak how they got the money. Then they found out how, along with the request filed on their behalf was a photo of tomatoes. \u201cThis is not mine at all,\u201d said Danijela.<\/p>\n<p>Raji\u0107 told CIN that his only connection with the grants was in that he helped people get some information. \u201cThey\u2019d say: \u2018The minister is yours, can you help us?\u2019 Since I took the responsibility to reorganize the Kiseljak (chapter), and we had our minister in the government, I tried to find some information,\u201d said Raji\u0107. His name was on the list of beneficiaries even though he told CIN that he did not receive a grant.<\/p>\n<p>Also on the list is Zlatko Cvjetkovi\u0107 from Kiseljak. He told CIN that he did some plumbing for Raji\u0107. Instead of paying Cvjetkovi\u0107 for the job he had done, Raji\u0107 asked for his and his wife\u2019s bank account numbers. Then he wired 1,600 KM to them. \u201cI don\u2019t know how it happened\u2014through Nenad Raji\u0107. I did not ask for a grant or something. I don\u2019t know who signed it off, but I said that this was not my writing,\u201d said Cvjetkovi\u0107. He kept the agreed money for his services and returned the rest to Raji\u0107. He told that to police who suspect Raji\u0107 of promising 100 KM for a vote for the party according to Lijanovi\u0107\u2019s instructions.<\/p>\n<p>The party\u2019s nominees for the BiH Presidency, the State and the FBiH Parliaments and the Assembly of Central Bosnian Canton won 3,486 votes at 2010 General Elections in the area of Kiseljak where Raji\u0107 operated.<\/p>\n<p>In August 2011, Terzi\u0107 got a job with the Ministry of Agriculture as the head of the Unit for Managing the Project \u201cSupplying Water and Sewerage in the FBiH\u201c. There was no published vacancy for this job opening. Asked how she found about it Terzi\u0107 said: \u201cWhen there\u2019s a will there\u2019s a way.\u201d<\/p>\n<p class=\"naslov\">To Parliament instead of Jail<\/p>\n<div class=\"infografika-min\">\n<figure id=\"attachment_35564\" aria-describedby=\"caption-attachment-35564\" style=\"width: 500px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/zapisnik_pecirep.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-35564\" src=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/zapisnik_pecirep.jpg\" alt=\"\" width=\"500\" height=\"694\" \/><\/a><figcaption id=\"caption-attachment-35564\" class=\"wp-caption-text\">Minutes from an inspection of grants.<\/figcaption><\/figure>\n<\/div>\n<p>The police report describes how after the grants were wired, inspection teams from the ministry paid visits to the beneficiaries and lied how everything was fine. Sanja Terzi\u0107, the party\u2019s representative in Novi Travnik, was a member of one of these teams. Terzi\u0107 ran in the last general and local elections, but lost.<\/p>\n<p>The grant beneficiaries from Novi Travnik told the police that the money was given away according to Terzi\u0107\u2019s instructions. She denied this: \u201dIt\u2019s all politics. The nationalists don\u2019t really like this party,\u201c she told CIN. She joined the party in 2009 and she said that she\u2019d always lobby for this party. \u201cNo one asked me if my children have something to eat, and Jerko did ask. I can never forget him for that.\u201d<\/p>\n<p>Lijanovi\u0107 told CIN that he had never paid the party\u2019s voters. He said that at the time when he was a legislator with the BiH Parliament he proposed that every citizen going to vote should be rewarded with 100 KM from the state budget. He said that he had sent this motion twice into the parliamentary procedure. Lijanovi\u0107 said that the motion was the reason why some voters expected money: \u201cI met with people who asked me what was going to happen with their 100 KM\u201c.<\/p>\n<p>The FBiH Prime Minister was receiving complaints about the irregularities connected with the payments of agricultural grants. \u201cWe as a government have set up a task force which made some investigations and has come up with a series of documents and reports for the police and prosecutors, \u201cNik\u0161i\u0107 told CIN.<\/p>\n<p>The Electoral Law in BiH stipulates fines of between 1,000 KM and 10,000 KM for persons and parties who promise money rewards to those who vote for them. Maksida Piri\u0107, a spokesperson for the Central Electoral Commission (CIK) explained that such complaints should have evidence. \u201cThose who might have some findings or some evidence, are free to send them to a respective prosecutor\u2019s office,\u201d he said.<\/p>\n<p>The president of a Tuzla non-governmental organization \u201cCitizen\u2019s Forum\u201d, Vehid \u0160ehi\u0107, told CIN that he was aware of vote buying. \u201cHere the elections are considered to be a special type of fight for power, because government is some sort of spoils,\u201d said \u0160ehi\u0107.<\/p>\n<p>According to the BiH Penal Code, tampering with voters by way of threat, intimidation, bribe or by taking advantage of their hard economic situation, is punishable by a fine or up to three years in prison. The punishment can be bigger \u2013 from six months to five years in prison \u2013 for an election official.<\/p>\n<figure id=\"attachment_35566\" aria-describedby=\"caption-attachment-35566\" style=\"width: 800px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-35566\" src=\"https:\/\/cin.ba\/wp-content\/uploads\/2021\/02\/sanja_terzic.jpg\" alt=\"\" width=\"800\" height=\"533\" \/><figcaption id=\"caption-attachment-35566\" class=\"wp-caption-text\">Sanja Terzi\u0107, the Party for Betterment\u2019s representative in Novi Travnik, got a job at an FBiH ministry even though there was no vacancy. (Photo: Facebook)<\/figcaption><\/figure>\n<p>Samard\u017ei\u0107 never served that time. His sentence was commuted into a fine of 18,000 KM. Nowadays he\u2019s the party representative in the FBiH Parliament. Samard\u017ei\u0107 told CIN that in 2010, the party\u2019s presidency offered him a compensatory term as he was a businessman. He accepted. \u201cI became a party member after the 2010 elections. I was not in the party\u2019s headquarters at those elections, nor was I talking to media or posters\u2026,\u201d said Samard\u017ei\u0107. He said that he was found guilty based on the testimony of Nisvet Duratovi\u0107 who said they had collected votes together. Duratovi\u0107 pleaded guilty to bribing and tampering with voters and was sentenced to probation.Hasan Samard\u017ei\u0107 from Cazin was sentenced before the state court for illegal lobbying of Party for Betterment\u2019s voters in 2010. The court fined him 4,000 KM and sentenced him to six months in jail at the end of May 2013 for \u201cviolating voters\u2019 freedoms\u201d.<\/p>\n<p>Samard\u017ei\u0107 said that after all of this he hopes for another compensatory term. \u201cI hope that just now the party won\u2019t forget me.\u201c<\/p>\n<p>Participation in the election irregularities has not harmed the party\u2019s other activists. Out of 57 incriminated persons in the report, at least 20 were the party\u2019s candidates in the latest elections in 2012.
